From the ban on advertising to betrayal of secrets

In addition to German and European antitrust law, competition law essentially comprises so-called unfair competition law. In the Unfair Competition Act (Gesetz gegen den unlauteren Wettbewerb – UWG), the legislator has defined the conditions, content and limits with which free entrepreneurial action towards third parties is restricted in sensitive areas. Hardly any other field of law is subject to such dynamic change as this one.

 

Only by constantly monitoring the further development of case law and accompanying specialist literature is it possible to show the companies affected by the effects of the UWG the paths that are necessary to avoid conflicts and that should be taken in the event of a conflict.
