Design / registered design

In contrast to patent protection, design protection does not cover the technical part of an invention, but the appearance of products, i.e. the external shape and color design of a product. LuxLaw-IP advises on all issues relating to the effective protection of product designs that can be registered as designs in Germany and as Community designs at European level. A particular challenge is often the avoidance of conflicts with unregistered Community designs, which – as the name suggests – arise without registration solely through “disclosure” and establish a three-year term of protection from this point in time.

LuxLaw- IP also focuses on the representation of companies in design law in the judicial assertion or defense of design law claims, which often have their origin – and often their end – in preliminary injunction proceedings.
