The AI law

AI law is one of the newest fields of law that was not freely created by the legislator as such, but had to be developed with a relatively short period of consideration based on technical developments. In this respect, numerous problem areas have not yet been conclusively addressed by the legislator.

In essence, there are three use cases:

  • Protection with AI
  • Protection through AI
  • Protection against AI

Liability issues relating to the (cross-border) use of AI, in particular with regard to the subject of liability, the scope and fault requirements, are the subject of intense debate. For this field of law in particular, it is crucial to continuously monitor the latest developments, especially in European legislation and case law, which must be used as a basis for drafting contracts and advising on liability issues.
